R.________ withdrew his criminal appeal against the Lausanne public prosecutor’s dismissal order. The Cantonal Criminal Appeals Chamber took note of the withdrawal and struck the case from the roll. Although a withdrawing appellant is normally treated as having lost and would bear the costs, the court exceptionally left the CHF 220 appeal fee to the State because of the circumstances. The decision was declared immediately enforceable.
Art. 386 al. 2 let. b CPP; withdrawal of appeal and costs after withdrawal: when an appeal is expressly withdrawn, the appellate court takes note of the withdrawal and strikes the matter from the roll. Under Art. 428 al. 1 CPP, the withdrawing appellant is in principle deemed to have failed and must bear the costs; however, Art. 423 CPP allows an exceptional allocation of costs to the State where the circumstances so justify.

Art. 386 al. 2 let. b CPP Statuant sur le recours interjeté le 19 septembre 2014 par R.________ contre l’ordonnance de classement rendue le 16 septembre 2014 par le Ministère public de l’arrondissement de Lausanne dans la cause n° PE13.021797-PGN, la Chambre des recours pénale considère : E n f a i t e t e n d r o i t : 1.Par écriture du 19 septembre 2014, R.________ a déclaré retirer son recours contre l’ordonnance rendue le 16 septembre 2014 par le Ministère public de l'arrondissement de Lausanne par souci de ne pas encourir de frais. Il convient dès lors d’en prendre acte et de rayer la cause du rôle.
2 - 2.La partie qui retire son recours étant considérée comme ayant succombé (art. 428 al. 1, 2 e phrase CPP [Code de procédure pénale du 5 octobre 2007; RS 312.0]), les frais de la procédure de recours, constitués en l'espèce du seul émolument d'arrêt, par 220 fr. (art. 20 al. 1 TFJP [tarif des frais judiciaires pénaux du 28 septembre 2010; RSV 312.03.1]), devraient en principe être mis à la charge de R.. Toutefois, compte tenu des circonstances, ils seront exceptionnellement laissés à la charge de l’Etat (art. 423 CPP). Par ces motifs, la Chambre des recours pénale prononce : I. Il est pris acte du retrait du recours II. La cause est rayée du rôle. III. Les frais d'arrêt, par 220 fr. (deux cent vingt francs), sont laissés à la charge de l’Etat. IV.
