R.________ withdrew his appeal against the prosecutor’s decision of 24 July 2013 concerning seized objects and assets. The Criminal Appeals Chamber took note of the withdrawal and struck the case from the roll. Applying the rule that a withdrawing appellant is deemed to have failed, the court charged the appeal costs, consisting solely of the court fee, in the amount of CHF 220, to R.________. The decision was rendered in camera by the Vaud Cantonal Court, Criminal Appeals Chamber, on 11 October 2013.
Art. 386 al. 2 let. b CPP; withdrawal of an appeal in criminal proceedings; when the appellant withdraws the appeal, the appellate court merely takes note of the withdrawal and strikes the case from the roll. The withdrawing party is deemed to have lost within the meaning of Art. 428 al. 1 CPP, so the appeal costs are normally borne by that party; here, the sole fee of CHF 220 was charged accordingly (consid. 1-2).

Art. 386 al. 2 let. b CPP La Chambre des recours pénale prend séance à huis clos pour statuer sur le recours interjeté par R.________ contre la décision concernant les objets et valeurs patrimoniales séquestrés rendue le 24 juillet 2013 par le Ministère public de l’arrondissement de La Côte dans la cause n° PE13.002903-JRU. Elle considère en fait et en droit : 1.Par écriture du 7 octobre 2013, R.________ a déclaré retirer le recours qu’il a interjeté le 5 août 2013 contre la décision concernant les objets et valeurs patrimoniales séquestrés rendue le 24 juillet 2013 par le Ministère public de l’arrondissement de La Côte. Il sied d’en prendre acte et de rayer la cause du rôle.
2 - 2.La partie qui retire son recours étant considérée comme ayant succombé (art. 428 al. 1, 2 e phrase CPP [Code de procédure pénale du 5 octobre 2007; RS 312.0]), les frais de la procédure de recours, constitués en l'espèce du seul émolument d'arrêt, par 220 fr. (art. 20 al. 1 TFJP [tarif des frais judiciaires pénaux du 28 septembre 2010; RSV 312.03.1]), doivent être mis à la charge de R.. Par ces motifs, la Chambre des recours pénale, statuant à huis clos, prononce : I. Il est pris acte du retrait du recours. II. La cause est rayée du rôle. III. Les frais d'arrêt, par 220 fr. (deux cent vingt francs), sont mis à la charge de R.. IV. Le présent arrêt est exécutoire. Le présent arrêt peut faire l'objet d'un recours en matière pénale devant le Tribunal fédéral au sens des art. 78 ss LTF (loi du 17 juin 2005 sur le Tribunal fédéral – RS 173.110), cas échéant d'un recours constitutionnel subsidiaire au sens des art. 113 ss LTF. Ces recours doivent être déposés devant le Tribunal fédéral dans les trente jours qui suivent la notification de l'expédition complète (art. 100 al. 1

The court took note of the withdrawal and struck the case from the docket.
Once the appeal was withdrawn, there was no longer a need to decide the merits, so the matter had to be removed from the roll.
Who bears the costs of the appeal proceedings after withdrawal
The appellant, as the withdrawing party, was treated as having lost and had to pay the appeal costs.
Under the CPC, the party withdrawing the appeal is deemed to have failed; the sole appellate fee of CHF 220 was therefore charged to him.
