The President of the Cantonal Criminal Cassation Court examined B.________’s appeal against a juvenile court judgment finding him guilty of simple bodily harm and imposing a suspended 3-day deprivation of liberty. The appeal had been filed only as a declaration, without conclusions or reasons. The court held that, under the CPP, a motivated brief had to be filed within 10 days after receipt of the full judgment. Because no such brief was filed in time, the court refused to enter into the merits and rejected the appeal preemptively. Second-instance costs were left to the State.
Art. 425 CPP, 431 al. 1 CPP; admissibility of a criminal appeal filed merely by declaration without a motivated brief: a party who submits only an unreasoned appeal declaration must, within the statutory time limit after receipt of the full judgment, file a motivated brief setting out conclusions and grounds. Failing timely submission of such brief, the appellate court cannot enter into the merits and must dismiss the appeal preemptively as manifestly inadmissible (consid. 2). Inadmissibility of the appeal entails no substantive review of the first-instance judgment and may justify leaving second-instance costs to the State.

Art. 425, 431 al. 1 CPP Vu le jugement du 29 septembre 2009, par lequel le Président du Tribunal des mineurs a, notamment, constaté que B.________ s'était rendu coupable de lésions corporelles simples (I) et lui a infligé trois jours de privation de liberté, avec sursis pendant un an (II); vu la déclaration de recours datée du 29 septembre 2009 contre le jugement précité,
éd., Bâle 2008, n. 10 ad art. 424 CPP, p. 518). Par ces motifs, le Président de la Cour de cassation pénale, statuant à huis clos, p r o n o n c e : I. Le recours est écarté préjudiciellement. II. Les frais de deuxième instance sont laissés à la charge de l'Etat.
