The appellant withdrew the appeal at the hearing before the Ticino Territorial Planning Court. The court held that the case had become moot and ordered the appeal struck from the docket. It further decided that no court fees or expenses would be collected. The decision was notified to the municipality, the cantonal department, the State Council, and the urban planning section.
Withdrawal of the appeal renders the proceedings devoid of object; the appellate court shall strike the case from the docket. In such circumstances, and absent any special reason to the contrary, no court fees or expenses are levied (consid. 1-2).
