Resumo

The appellant challenged the State Council’s approval of a revision of the zoning plan and a detailed plan for the municipality. Before the Tribunal of Territorial Planning ruled on the merits, the appellant’s counsel informed the court that the appeal was withdrawn. The tribunal therefore struck the case from the docket and decided that no court fees or expenses would be charged.

Withdrawal of an administrative appeal before the planning court; the proceedings are struck out without a merits ruling, and in the absence of a contrary allocation the court may waive fees and expenses. The decision is purely procedural and follows from the appellant’s unilateral discontinuance of the challenge, as noted in the dispositive section (consid. implied).
