Resumo

The Ticino Tribunal for Territorial Planning dealt with an appeal against a State Council resolution concerning forest clearing in a municipality. After the appellants withdrew the appeal by letter of 29 April 1998, the court held that the case had become moot and ordered the appeal struck from the docket. It further decided that no court fees or costs would be charged.

Withdrawal of appeal; loss of object of the proceedings; the appeal is struck from the roll as moot. Where the appellants withdraw their challenge and the dispute no longer has a practical object, the court will terminate the proceedings without deciding the merits. In such circumstances, the court may also refrain from charging fees and costs (consid. implicit in the dispositive part).
