The appellants lodged an appeal in 1996 against the State Council’s approval of the zoning plan. After the Tribunal invited observations in 2004, the appellants stated on 5 October 2004 that they were withdrawing the appeal because the variant approved in 2003 had satisfied them with respect to their property. The Tribunal held that the proceedings were thus exhausted, struck the appeal from the docket, and ordered that no fees or costs be levied.
Withdrawal of an appeal before the Tribunal deems the proceedings exhausted; the court strikes the matter from the docket. In the absence of a pending dispute after withdrawal, no court fees or costs are charged where the decision so provides.

la decisione 3 luglio 1996 (n. 3444) con cui il Consiglio di Stato ha approvato il piano regolatore del già comune di __________, ora comune di __________;
preso atto che, dando seguito alla lettera 1°ottobre 2004 del Tribunale della pianificazione del territorio, con scritto 5 ottobre 2004 i ricorrenti hanno comunicato di ritirare il gravame, dichiarandosi soddisfatti delle modifiche apportate, sulla loro proprietà (mapp. 2002), tramite la variante approvata dal Consiglio di Stato con risoluzione 11 febbraio 2003 (n. 619);
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
