The Tribunal of Territorial Planning dealt with an appeal against the State Council’s resolution approving an inventory of buildings outside the building zone. Before a merits decision, the appellant withdrew the appeal by letter of 8 June 1998. The court held that the case had become moot and struck the appeal from the roll. It also ordered that no court fees or expenses be levied.
Withdrawal of an appeal renders the proceedings devoid of object; the court shall strike the case from the roll without examining the merits. In such circumstances, the court may order that no fees or costs be levied, particularly where no substantive adjudication is rendered.
