The appellants withdrew their appeal against the State Council’s approval of the revision of a municipal zoning plan after an agreement had been reached between the parties. The Territorial Planning Court held that an appeal that becomes devoid of object or legal interest must be struck off ex officio or on request. It therefore removed the appeal from the docket and ordered that no court fees or costs be levied.
Appeal withdrawn after settlement; striking off of the docket when the proceedings become devoid of object or legal interest. The court may, ex officio or on request, remove a case from the docket where the appeal loses its object through consensual withdrawal. In such circumstances, the proceedings are terminated without adjudication on the merits; no fees or costs are levied where the decision so provides (consid. 1).
