Resumo

The Tribunal della pianificazione del territorio dealt with an appeal against a 31 March 1993 State Council resolution approving variants to the municipal regulatory and detailed plans. After the appellant withdrew the challenge by letter of 28 January 1998, the court held that the case had become moot and struck the appeal from the docket. It further ordered that no court fees or expenses be levied.

Appeal withdrawn; mootness; striking off the docket; no court costs. Where the appellant formally withdraws the challenge before judgment, the court declares the matter devoid of object and removes it from the roll. In such circumstances, and absent contrary indications, no fees or costs are charged (consid. 1-2).

visto che con lettera 28 gennaio 1998 il rappresentante del ricorrente ha dichiarato di ritirare l’impugnativa;

rilevato che la causa é divenuta priva d’oggetto;
