Resumo

The appellant filed an administrative planning-law appeal against a State Council resolution. In a letter of 8 September 2000, the appellant’s representatives withdrew the appeal. The Tribunal of Territorial Planning therefore held that the case had become moot and ordered the appeal struck from the docket. It further decided that no court fees or costs would be charged. The decision was issued in Lugano on 11 September 2000 by the tribunal composed of Efrem Beretta, Giovanna Roggero-Will, Michele Rusca, with Fiorenzo Gianinazzi as clerk.

Withdrawal of appeal; mootness and costs: where the appellant withdraws the administrative appeal, the proceeding becomes devoid of object and the court orders it struck from the docket. In such a situation, and absent any special grounds, no court fees or costs are levied (consid. 1-2).
