In a tax matter, the appellant withdrew the appeal by letter after filing it. The Camera di diritto tributario of the Ticino Court of Appeal held that the withdrawal rendered the appeal moot and ordered it struck from the docket. It further decided that no costs or justice fee would be charged.
Art. 207 cpv. 2 LT, Art. 228 LT, Art. 134 cpv. 2 and Art. 142 cpv. 4 LIFD; withdrawal of an appeal renders the proceeding devoid of object and justifies striking the case from the docket. Where the appeal is removed following withdrawal, the court may order that no expenses or justice fee be levied.
