The Tax Chamber of the Cantonal Court of Appeal in Lugano dealt with an appeal against a disciplinary fine. By letter of 15 November 2001, the appellant withdrew the appeal. The court held that the matter had become devoid of object and ordered the appeal struck from the docket. It also decided that no court costs or justice fees would be levied.
Appeal withdrawn before decision; mootness and striking off the docket; costs. When the appellant withdraws the appeal, the proceedings become devoid of object and the court strikes the case from the docket. In such circumstances, the court may order that neither judicial fees nor court costs be charged, where the applicable tax and federal provisions so provide (consid. 1-2).
