In a cantonal tax appeal concerning IC 96 and IDS 96, the appellant withdrew the appeal by letter of 25 August 2000. The Tax Chamber of the Court of Appeal held that the withdrawal rendered the proceeding moot and ordered the case struck from the docket. It further decided that no court costs or justice fees would be levied.
Art. 207 cpv. 2 LT; art. 228 LT; art. 134 cpv. 2 LIFD; art. 142 cpv. 4 LIFD: withdrawal of an appeal causes the proceeding to lose its object and justifies striking it from the docket. In such circumstances, the court may waive the collection of court costs and justice fees.
