In a tax appeal concerning the quantification of a legal mortgage, the appellant withdrew the appeal by letter of 6 February 1996. The Tax Chamber of the Court of Appeal held that the appeal had therefore become moot and ordered it struck from the docket under Art. 181 cpv. 2 LT. The court also ordered that no court costs or justice fee be charged.
Art. 181 cpv. 2 LT; withdrawal of appeal and lack of subject matter; when the appellant withdraws the appeal, the court notes the loss of the dispute and strikes the case from the docket. In such circumstances, the proceedings are terminated without a decision on the merits, and no court costs or justice fee are levied if the court so orders in light of the withdrawal (consid. on mootness and costs).
