The Ticino criminal appeals chamber acknowledged that heirs may in principle have some interest in learning the outcome of the proceedings, but held that the long lapse of time and the right to oblivion prevailed. The application was therefore rejected, and no court fees or costs were imposed.

Art. 27 CPP; access to a criminal file by the heir of a deceased injured party in light of the right to oblivion. An heir may in principle have a legitimate interest in learning the outcome of an old criminal proceeding involving the deceased, but this interest is not absolute. Where a very long time has elapsed since the facts and the judgment, the interests must be balanced and the right to oblivion may prevail, justifying refusal of access (consid. unspecified). The particular circumstances may also warrant waiver of court fees and expenses.

sedente per statuire sull’istanza 15/18.9.2006 presentata da

IS 1

tendente ad ottenere l’accesso agli atti di un procedimento penale risalente al 1978 nel quale il defunto padre del qui istante era stato parte lesa;

ritenuto il lungo tempo trascorso dai fatti (autunno 1977) e dalla sentenza (13.5.1978);

considerato che si può di principio ammettere un certo interesse degli eredi della defunta parte civile a conoscere l’esito del procedimento;

ritenuto però che dall’altra parte vi è il diritto all’oblio, come riconosciuto anche dal Tribunale federale (DTF 122 III 457);

reputato che, in una ponderazione degli interessi, debba prevalere quello all’oblio;

considerato pertanto che la richiesta, comprensibile, deve essere respinta;

ritenuto che, data la particolarità del caso, si rinuncia alla tassa di giustizia ed alle spese.

Per questi motivi,

visto l’art. 27 CPP,

pronuncia

  1. L’istanza è respinta.

  2. Non si prelevano tassa di giustizia e spese.
