preso atto che il 16 agosto 2005 il patrocinatore del ricorrente ha comunicato di ritirare il ricorso in quanto Fréderic Budmiger è nel frattempo deceduto;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
