Resumo

The appellants challenged an administrative decision prohibiting use of a serving counter until a building permit was obtained. Before the cantonal administrative court decided the merits, counsel notified the court on 28 October 2002 that the appeal was withdrawn. The court therefore held that the proceedings were exhausted and ordered the appeal struck from the docket. It also decided that no court fees or costs would be levied.

Withdrawal of an administrative appeal; removal from the docket. When the appellant validly withdraws the appeal, the dispute is extinguished and the court must strike the proceedings off the roll without entering into the merits. In the absence of a live controversy, no fees or costs are levied if the court so orders (consid. implicit).
