statuendo sul ricorso 30 marzo 1998 di
patrocinato da: St.leg. __________
contro
la risoluzione 11 marzo 1998, no. 964, del Consiglio di Stato che respinge il ricorso 15 gennaio 1998 dell'insorgente interposto contro la decisione 17 dicembre 1997 del municipio di __________ per abusi edilizi;
preso atto che in occasione dell’udienza di sopralluogo 13 maggio 1998, dopo discussione, il Giudice Delegato ha proposto alle parti la seguente transazione:
" 1. Il municipio rinuncia ad esigere la demolizione delle opere realizzate abusivamente ed infligge alla ricorrente una sanzione pecuniaria di fr. 13'000.-- oltre alla multa di fr. 5'000.-- (totale fr. 18'000.--).
A questa condizione la ricorrente ritira il ricorso.
In caso di accettazione la causa verrà stralciata dai ruoli senza spese e senza ripetibili.
Alle parti è assegnato un termine di 5 giorni per pronunciarsi ritenuto che la ricorrente dichiara già sin d'ora di accettare la proposta.
In caso di rifiuto da parte del municipio il Tribunale cantonale amministrativo statuirà sul ricorso senza ulteriori formalità ritenuto che le parti rinunciano già sin d'ora alle conclusioni e al dibattimento finale."
rilevato che con scritto 14 maggio 1998 il municipio di __________ ha aderito alla proposta transattiva di cui sopra;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
