An employee appealed a municipal decision of 25 February 1997 terminating the employment relationship. Before the administrative court could decide, the municipality revoked the challenged decision on 7 May 1997. The court therefore held that the appeal had become moot and ordered it struck from the docket. It also decided that no court costs or justice fee would be charged.
PAmm; when the challenged administrative act is withdrawn or revoked during appeal proceedings, the appeal loses its object and is to be struck from the docket as moot. In such a situation the court does not examine the merits of the original dispute; it merely records the extinction of the controversy and may dispense with costs where appropriate (consid. 1).

dichiara e pronuncia:
Il ricorso è stralciato dai ruoli siccome privo d’oggetto.
Non si prelevano nè spese, nè tassa di giustizia.
