The appellants challenged a 25 June 1997 State Council resolution concerning compulsory connection to the sewer network. On 4 October 2005, their counsel informed the Administrative Court that, following an agreement, the appeal was being withdrawn. The court held that the proceedings were therefore exhausted, ordered the appeal struck from the docket, and decided that no fees or costs would be charged.
Withdrawal of the appeal; the proceedings end without a merits ruling once the appellant withdraws the challenge after settlement. In such a case the court strikes the matter from the docket. Unless otherwise provided, no court fees or costs are levied when the proceedings are terminated by withdrawal (consid. 1-2).
