The appellant challenged the State Council’s inadmissibility decision concerning completion of a sewer pipeline in an industrial zone. Before judgment, the appellant withdrew the appeal, stating that compensation issues had been settled out of court. The Administrative Court therefore struck the case from the docket and ordered that no court fees, costs, or party compensation be collected.

la decisione 23 ottobre 1996, no. 5407, del Consiglio di Stato che dichiara irricevibile il ricorso presentato da __________ interposto contro la decisione 8 gennaio 1996 del municipio di __________, relativa alla completazione della posa della canalizzazione facente parte del progetto di evacuazione delle acque meteoriche nella zona industriale J1 a __________ fino al pozzetto no. 4;
preso atto che in data 10 dicembre 1997 l'insorgente ha comunicato di ritirare il ricorso ritenuto che le ripetibili sono state oggetto di separato accordo extra-giudiziario;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
