The Administrative Court heard an appeal against a State Council decision in an environmental/building-related matter. statuendo sul ricorso 23 ottobre 1996 di

__________ patrocinato da: avv. __________

contro

la decisione 3 ottobre 1996, no. 5045, del Consiglio di Stato che accoglie parzialmente l'impugnativa inoltrata dall'insorgente avverso la decisione 1° marzo 1995 del municipio di __________ in materia edilizia;

ritenuto che all’udienza di sopralluogo del 15 luglio 1997, non è stato possibile accertare sulla base delle fotografie agli atti e della situazione dei luoghi se il fondo __________ è stato effettivamente oggetto di interventi di colmataggio o se questi siano circoscritti al vicino fondo __________;

rilevata la particolarità della fattispecie, su proposta del Giudice Delegato, il municipio di __________ ha dichiarato pertanto di rinunciare a procedere nei confronti del signor __________ sulla base della procedura avviata il 22 marzo 1993, fermo restando quanto di competenza dell'UPN nell'adempimento del mandato conferitogli dal legislatore federale in ordine alla protezione ed al ripristino delle zone paludose;

preso atto di quanto sopra, il ricorrente si dichiara d'accordo di stralciare il ricorso dai ruoli senza ulteriori formalità, ritenuto che rinuncia all'assegnazione di ripetibili;

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.

Non si assegnano ripetibili.
