Resumo

In a building-law appeal before the Ticino Administrative Court, the parties reached a settlement at the site inspection hearing. The appellant withdrew the appeal, while the respondent undertook not to use the west terrace for restaurant purposes without prior municipal authorization. The appellant also renounced the request for guardrails on three west-facing restaurant windows. The court therefore struck the appeal from the docket and ordered no court fees or costs, with party costs compensated.

la decisione 29 maggio 1996 del Consiglio di Stato (n. 2718) in materia edilizia;

preso atto che in occasione dell'udienza di sopralluogo del 23 gennaio 1997, su proposta del giudice delegato, le parti sono addivenute alla seguente transazione:

"

La Comunione ereditaria resistente si impegna a non utilizzare la terrazza ovest per uso ristorante senza aver preventivamente chiesto ed ottenuto l'autorizzazione del municipio.

I ricorrenti rinunciano ad esigere che le 3 finestre del ristorante (lato ovest) vengano dotate di parapetto a ringhiera.

I ricorrenti ritirano il ricorso.

La causa verrà stralciata dai ruoli senza spese, compensate le ripetibili."

considerato pertanto che il procedimento è così esaurito;

decreta:

  1. Il ricorso è stralciato dai ruoli.

  2. Non si prelevano né tasse, né spese.
