la sentenza 27 novembre 1995 del Tribunale cantonale amministrativo che annulla la decisione 28 settembre 1995 del Consiglio di Stato e la licenza edilizia 17 luglio 1995 rilasciata loro dal municipio di __________;
viste le risposte:
12 dicembre 1995 di __________;
13 dicembre 1995 del comune di __________;
18 dicembre 1995 del Dipartimento del territorio;
24 gennaio 1996 del Consiglio di Stato;
preso atto che il resistente ha dichiarato di aderire alla domanda alla condizione di essere liberato da ogni tassa di giustizia;
visti gli art. 3, 28, 35 PAmm
dichiara e pronuncia:
§. di conseguenza:
1.1. la sentenza 27 novembre 1995 (n. 269/95) è revocata.
1.2. la decisione 28 settembre 1995 (n. 5336) è ripristinata limitatamente al dispositivo n. 1.
1.3. la licenza edilizia 17 luglio 1995 rilasciata dal municipio di __________ a __________ è confermata.
Non si assegnano ripetibili.
