The cantonal administrative court dealt with an appeal against a building permit decision concerning reconstruction of a pre-existing building. la decisione 23 maggio 1995, no. 2875 del Consiglio di Stato con la quale si respinge il ricorso 10 febbraio 1995 di __________ e llcc contro la decisione 25 gennaio 1995 del municipio di __________ che concede la licenza edilizia per la ricostruzione del fabbricato preesistente ai mappali no. / RFD __________;
rilevato che in occasione dell’udienza di sopralluogo del 13 ottobre 1995, dopo ampia discussione, il Giudice Delegato ha proposto alle parti la seguente transazione:
"1. La costruzione viene sopraelevata soltanto fino alla quota di + 8.70 al filo di gronda (eliminazione del solaio e abbassamento di 50 cm della soletta sommitale).
1 bis. La parte resistente si impegna a non opporsi ad una domanda di rifacimento del tetto e dell'intonaco del rustico che sorge sulla proprietà dei ricorrenti.
I ricorrenti ritirano il ricorso.
Il Tribunale cantonale amministrativo stralcerà la causa dai ruoli senza spese e senza assegnazione di ripetibili.
In caso di accettazione della proposta transattiva, il rappresentante dello Stato dichiara che lo Stato rinuncerà ad esigere la tassa di giustizia emanata con la decisione di I. istanza."
ritenuto che la parte resistente ha dichiarato di accettare la proposta transattiva seduta stante;
preso atto che in data 25 ottobre 1995 il patrocinatore dei ricorrenti ha comunicato la propria adesione alla soluzione transattiva e contemporaneamente ha ritirato il ricorso;
considerato pertanto che il procedimento è così esaurito;
decreta:
Il ricorso è stralciato dai ruoli.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
