The Ticino Administrative Court dealt with an appeal against a 15 December 1994 decision of the Department of Institutions, Permits and Passports. On 10 January 1996, the appellant's counsel informed the court that the appeal was withdrawn. The court held that the proceedings were thereby exhausted and ordered the appeal struck from the docket. It further decided that no court fees or expenses would be collected.
Administrative appeal withdrawn; proceedings become moot and are struck from the docket. Where the appellant validly withdraws the appeal before judgment, the court no longer enters into the merits and terminates the proceedings. Absent a specific basis to the contrary, no court fees or expenses are levied (cf. consid. 1-2).
