The Ticino cantonal administrative court dealt with an appeal against an expropriation decision. The parties then reached a settlement that resolved the expropriation indemnity as well as costs and party indemnities. The court held that the appeal had become moot and ordered it struck out of the docket. It further decided that no court fees or costs would be charged and that no party indemnities would be awarded.
Mootness after settlement; where the parties settle the underlying dispute and also regulate costs and indemnities, the appeal loses its object and is struck out of the docket. In such circumstances the court does not levy judicial fees or costs and does not award party indemnities, the settlement having exhausted the procedural interest in a judicial determination.

la decisione 8 novembre 1999 del Tribunale di espropriazione della giurisdizione sottocenerina (no. 49/98-178);
preso atto che tra le parti è stato raggiunto un accordo transattivo circa l'indennità d'espropriazione;
rilevato che le parti si sono accordate anche su spese e ripetibili;
ritenuto pertanto che il ricorso è divenuto così privo di oggetto;
decreta:
Il ricorso è stralciato dai ruoli poiché divenuto privo di oggetto.
Non si prelevano né tasse, né spese.
Non si assegnano ripetibili.
