The Ticino Cantonal Insurance Court dealt with an appeal against a 15 April 1997 decision of the Federal Military Insurance Office. After a court-appointed expert report was filed, the appellant’s counsel withdrew the appeal. The court found that the case had become moot and ordered the proceedings struck off the docket, without charging fees or costs.
Withdrawal of appeal and mootness; striking off the docket and costs. Where the appellant withdraws the appeal after the decisive factual or evidentiary basis has changed, the proceedings become devoid of object and are removed from the docket. In such a situation, and absent special circumstances, no court fees or costs are levied (Law of Procedure of 6 April 1961).
