considerato
che con petizione 30 ottobre 2003 __________ si è rivolto al Tribunale Cantonale delle Assicurazioni chiedendo la condanna della __________ al versamento di indennità giornaliere dal 4 al 15 giugno 2003 oltre ad accessori e spese;
che in data 16 dicembre 2003 __________ ha comunicato all’attore, rappresentato dall’__________, la sua adesione alla petizione;
che il giorno successivo __________ ha chiesto la sospensione della procedura in vista di un completo accordo transattivo tra le parti;
che il 9 gennaio 2004 il Giudice delegato ha interpellato __________ al fine di conoscere gli sviluppi degli accordi tra le parti;
che il successivo 19 gennaio 2004 il rappresentante dell’attore ha comunicato il ritiro della petizione a seguito dell’avvenuto pagamento delle indennità pattuite;
che il ritiro della petizione rende priva d’oggetto la procedura che può, di conseguenza, essere stralciata dai ruoli senza carico di tasse e spese;
Per questi motivi,
decreta 1. il ricorso di cui sopra è stralciato dai ruoli;
non si prelevano tasse e spese e non si attribuiscono ripetibili;
intimazione alle parti a sensi ed effetti di legge.
