The insured appealed to obtain a formal decision from the health insurer concerning dental treatment for her son. Before the court decided the matter, the insurer issued the requested formal decision on 21 February 2003 and fully accepted the treatment costs. The insured then withdrew the appeal. The TCA held that the appeal had become devoid of object and ordered the case struck from the roll. No taxes or costs were imposed.

Appeal becomes moot when the requested administrative decision is issued and the substantive relief sought is fully granted; in such circumstances the proceedings are struck from the roll. Where the appellant withdraws the appeal after satisfaction of the claim, there is no live controversy requiring adjudication, and no court costs need be charged unless otherwise justified.

visto il ricorso del 18 febbraio 2003 interposto da

contro

Cassa Malati __________

in materia di assicurazione sociale contro le malattie

letti ed esaminati gli atti;

rilevato che con il gravame l'assicurata postulava l'emanazione da parte della Cassa Malati __________ di una decisione formale relativa al trattamento dentario per il figlio __________ (cfr. Doc. _);

preso atto che la Cassa, in data 21 febbraio 2003, ha emanato la chiesta decisione ed ha integralmente assunto i costi per il trattamento dentario in questione come postulato dalla ricorrente (cfr. Doc. _);

constatato che la signora __________, con scritto 21 marzo 2003, ha comunicato di conseguenza il ritiro del gravame (cfr. Doc. _);

rilevato che il gravame è divenuto privo di oggetto;

decreta 1. il ricorso di cui sopra è stralciato dai ruoli;

  1. non si percepiscono né tasse né spese;

intimazione alle parti a sensi ed effetti di legge.
