In a social-insurance appeal before the Ticino Cantonal Insurance Court, the appellant’s counsel informed the court that the appeal was to be withdrawn after receipt of additional medical documentation and consultation with the appellant. The court held that the case had become moot and ordered it struck from the docket. It also ordered that no court fees or costs be collected. The respondent had previously sought dismissal of the appeal.

in materia di assicurazione contro gli infortuni
letti ed esaminati gli atti;
vista la risposta 10 settembre 2004 della parte convenuta che propone la reiezione del gravame;
vista la lettera 26 ottobre 2004 della RA 1 del seguente tenore:
" Ci riferiamo al nostro fax del 21 c.m., a seguito del quale abbiamo ricevuto l'ulteriore documentazione del dott. __________, medico curante del ricorrente.
Sulla base della medesima e previo colloquio con il signor RI 1, v'informiamo che è nostra intenzione ritirare il ricorso inoltratovi il 2 settembre 2004.
Vi preghiamo pertanto di procedere in tal senso e nel frattempo vi porgiamo i nostri migliori saluti." (cfr. Doc. X)
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.1961;
decreta 1. la causa è stralciata dai ruoli:
non si prelevano né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.

Whether the appeal should remain pending after the appellant’s withdrawal
The appeal proceedings were terminated and the case struck from the docket because the matter had become moot following withdrawal.
Counsel for the appellant informed the court that, after reviewing additional medical documents and consulting the appellant, the appeal would be withdrawn; therefore no object remained for adjudication.
