richiamata l'ordinanza 24 maggio 2004 con la quale il Tribunale ha assegnato alla parte convenuta il termine di rito per presentare la risposta;
vista la lettera 21 giugno 2004 della ATTO1 del seguente tenore:
" Abbiamo ricevuto il pagamento dell'intero importo posto in esecuzione, che pone fine alla vertenza.
La causa deve quindi essere stralciata dai ruoli." (doc. III);
rilevato che la causa è divenuta di conseguenza priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
