In a professional pension dispute, the claimant informed the Ticino insurance court that the amount pursued had been paid and asked to withdraw the petition. visto lo scritto 23 settembre 2002 con cui la Fondazione attrice ha comunicato al TCA:
" In seguito al versamento dell'importo posto in esecuzione, vi invitiamo a ritirare la petizione del 12.6.02 per intervenuto pagamento." (cfr. Doc. _)
rilevato che di conseguenza la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
