letti ed esaminati gli atti;
richiamata l'ordinanza 25 ottobre 2001 con la quale il Tribunale ha assegnato alla parte convenuta il termine di rito per presentare la risposta (II);
vista la documentazione prodotta dalla convenuta in allegato agli scritti 14 novembre e 6 dicembre 2001 da cui risulta che pendente lite essa ha provveduto a notificare il dipendente __________ al proprio istituto di previdenza e che quest'ultimo ha quindi allestito il relativo certificato personale (VI, IX);
richiamati gli ulteriori scritti 11 gennaio 2002 e 10 aprile 2002 con cui la convenuta, a seguito delle osservazioni presentate dal rappresentante di parte attrice in data 2 gennaio 2002 ha rettificato l'ammontare dei salari notificati all'istituto di previdenza e prodotto un nuovo certificato personale valevole dal 1 gennaio 2002 (XI, XIII, XVI);
viste le lettere 5 e 13 giugno 2002 con cui il rappresentante di parte attrice ha comunicato a questo Tribunale che "per quanto concerne le pretese avanzate con la presente istanza, siamo ampiamente soddisfatti" rispettivamente ha dichiarato di "ritirare la petizione" (XIX,XXI);
rilevato che la causa è divenuta priva di oggetto;
considerato l'esito della procedura appare giustificato assegnare a __________ fr. 500 a titolo di ripetibili;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
La __________ verserà alla parte attrice fr. 500.- a titolo di ripetibili;
intimazione alle parti a sensi ed effetti di legge.
