The social insurance court dealt with a damages action under Art. 52 LAVS. After the case had been suspended, the fund informed the court that the respondent had paid CHF 19,996.80 in full settlement of the claim and asked for the case to be struck. The court found that the dispute had become moot, removed the matter from the roll, and ordered that no court fees or costs be collected.
Art. 52 LAVS; mootness after full payment of the claimed amount. Where, during suspended proceedings, the respondent satisfies the claimed debt in full, the dispute loses its subject matter and the court must strike the case from the rolls. In such circumstances, no court fees or costs are levied, absent special grounds to depart from the ordinary rule (consid. 2).

rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.1961;
decreta 1. la causa è stralciata dai ruoli:
non si prelevano né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
