The appellant challenged a 19 December 2003 decision before the Pretura penale in Bellinzona. Before the court ruled, the Traffic Section submitted a letter proposing annulment of the decision. The president of the Pretura penale therefore annulled the challenged decision and ordered that no fees or costs be charged.
When the administrative authority itself proposes the annulment of the contested decision, the appeal may be disposed of by annulling that decision; if the matter is resolved in this way, no court fees or costs are levied.
