The President of the Pretura penale in Bellinzona examined an appeal against a decision of the Ufficio esazione e condoni. The appellant had originally challenged the measure, but during the proceedings the CHF 400 contravention fine was paid. The court held that the appeal had therefore lost its object and declared it moot. As a consequence, it annulled the administrative decision. No court fees or costs were charged.
Art. 1 segg. LPContr; an appeal against a contravention matter becomes moot when the full fine is paid during the proceedings. If the contested sanction is satisfied, the court no longer has a live dispute to decide and must declare the appeal devoid of object; the challenged decision is then to be annulled. In such circumstances, no fees or costs need be levied, absent a specific contrary basis.
