The appellant challenged a decision of the Sezione della circolazione before the Bellinzona Pretura penale. While the appeal was pending, the Sezione della circolazione asked on 18 March 2003 that its own decision be annulled in the order proceedings. The President of the Pretura penale therefore struck the appeal from the roll and ordered that no fees or expenses be charged. The decision was issued by President Marco Kraushaar with secretary Paola Belloli-Ducoli.
