The President of the Pretura penale dealt with an appeal against a 17 January 2003 decision of the Sezione della circolazione. Before the court ruled on the merits, the traffic authority asked on 28 February 2003 that its own decision be annulled. The court therefore annulled the challenged decision and struck the appeal from the roll. It also ordered that no fees or costs be charged.
Where the administrative authority requests annulment of the challenged decision during pending proceedings, the court may annul the contested act and strike the appeal from the roll; in such circumstances, if the matter becomes devoid of object, no fees or costs are to be levied. The procedural termination follows from the absence of a live dispute, not from a merits determination.
