The President of the Pretura penale granted the request to convert an unpaid CHF 500 fine into arrest after collection attempts failed. considerato pertanto che occorre procedere alla commutazione della multa inflitta, in ragione di un giorno di arresto ogni fr. 30.-- di multa, ma al massimo novanta giorni;
richiamati gli art. 49 cifra 3 CP e 347 CPP,
pronuncia 1. L'istanza del IS0 di commutazione della multa in arresto è accolta.
Di conseguenza la multa di fr. 500.-- inflitta a _________ con decreto numero DA / di data ____________________ 2003, è commutata in 16 giorni di arresto.
