In enforcement proceedings for conversion of a fine into arrest, the Pretura penale found that the convicted person had already paid the amount due. It therefore ordered that the conversion proceedings be struck from the docket and notified the parties. The decision was issued by President Marco Kraushaar on 2 February 2004.
Payment of the amount due in conversion proceedings renders the request for conversion devoid of purpose; the court shall strike the proceedings from the docket. The decision is one of procedural termination in enforcement, since the coercive measure can no longer be justified once the debt has been settled (consid. 1).
