The convicted person asked to pay a criminal fine and costs in installments. After the public prosecutor had waived CHF 500 of the court fees and costs, the Pretura penale held that it was competent under Art. 347 CPP to regulate installment payment and found that the debtor could not pay the fine in a single amount. It therefore granted payment of the CHF 1,200 fine in 12 monthly installments, with the first installment due on the date fixed in the decree.
