In execution proceedings before the Pretura penale, the President held that the convicted person had paid the amount due. As a result, the pending procedure to convert the fine into arrest was struck off the docket and the parties were notified.
Criminal enforcement proceedings; conversion of a fine into arrest becomes devoid of purpose once the amount due has been paid. In such a case, the deciding authority may strike the proceedings from the docket without further examination of the conversion request.
