RI 1 appealed against the 20 September 2005 decision of the Pretore of Locarno-Città. The president of the Civil Cassation Chamber ordered an advance of CHF 200 and warned that failure to pay would cause the appeal to be treated as deserted under Art. 312 CPC. As the deadline expired without payment, the court struck the appeal from the docket and charged the appellant CHF 50 in costs.
Art. 312 CPC; failure to pay the ordered advance on judicial costs within the fixed time limit, after warning, entails non-prosecution of the appeal. Once the deadline has expired unused, the appellate court must strike the matter from the roll without examining the merits; the appellant bears the ensuing court costs.

la decisione 20 settembre 2005 del Pretore della giurisdizione di Locarno-Città nella causa promossa da
CO 1 CO 2 (entrambi rappr. da RA 2 )
richiamata la diffida 11 ottobre 2005 della presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 3 novembre 2005 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 200.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;
preso atto come il termine in questione sia infruttuosamente trascorso;
decreta 1. Il ricorso 3 ottobre 2005 di RI 1 , avverso la decisione 20 settembre 2005 del Pretore della giurisdizione di Locarno-Città, è stralciato dai ruoli per mancato versamento dell'anticipo.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico del ricorrente.
