A civil cassation complaint was filed against a Federal Tribunal section decision. The Civil Cassation Chamber of the Ticino Court of Appeal held that, under Art. 327 CPC, only judgments of justices of the peace and district judges acting as sole instance can be challenged by civil cassation. Because the challenged decision came from the Federal Tribunal, the complaint fell outside the chamber's jurisdiction and was declared inadmissible. In view of the special circumstances, no court costs or justice fee were charged, and the legal aid request became moot.

Art. 327 CPC; admissibility of civil cassation complaints: cassation lies only against judgments of justices of the peace and pretors sitting as sole instance. Decisions rendered by a Federal Tribunal chamber are excluded ratione materiae from the cantonal cassation instance’s competence and must be declared inadmissible irrespective of any further considerations. Where no costs are levied, a pending request for legal aid becomes devoid of object (consid. 1-3).

che decisioni di una sezione del Tribunale federale –che è la massima autorità giudiziaria svizzera– mai potrebbero rientrare nelle competenze di questa Camera;

che, a prescindere da ogni altra considerazione, il ricorso non è ricevibile;

che la particolarità della fattispecie giustifica di non prelevare spese né tassa di giustizia;

che pertanto diviene priva d’oggetto la domanda di assistenza giudiziaria presentata dal ricorrente;

pronuncia: 1. Il ricorso per cassazione 17 agosto 1998 di ___________ è inammissibile.
