AP 1 appealed a 5 December 2005 judgment of the Lugano District Court, section 3, which had ordered payment of CHF 10,267.60 plus 5% interest from 5 November 2000 in favor of AO 1. Before the appellate court decided the merits, AP 1 informed the court on 5 April 2006 that the appeal was withdrawn. The Second Civil Chamber of the Cantonal Court of Appeal therefore struck the appeal off the docket for withdrawal and charged CHF 100 in costs to the appellant.

Where the appellant expressly withdraws the appeal, the appellate court takes note of the desistance and orders the proceedings struck from the roll without examining the merits. In principle, the withdrawing appellant bears the appellate costs, including the justice fee (cf. considerations relating to desistance and cost allocation).

Vista la comunicazione 5 aprile 2006 dell¿appellante che dichiarare di ritirare l¿appello
decreta: 1. L'appello 10 gennaio 2006 di AP 1 avverso la decisione 5 dicembre 2005 del Pretore del Distretto di Lugano, sezione 3, è stralciato dai ruoli per desistenza.
Le spese del presente giudizio con tassa di giustizia per complessivi fr. 100.-- sono poste a carico dell'appellante.
