che il Pretore, con sentenza 8 aprile 2004, ha respinto, confermando in via definitiva il rigetto dell'opposizione interposta al PE n. __________ dell'UE di __________, limitatamente a
fr. 182'810.– più interessi come a PE.
Appellante l'attore il quale, con atto d'appello 27 aprile 2004, chiede la riforma del primo giudizio nel senso di accogliere l'azione di disconoscimento di debito mentre la convenuta, con osservazioni 16 giugno 2004, postula la reiezione dell'appello.
Ed ora sullo scritto 6 luglio 2004 dell'avv. dott. __________, patrocinatore dell'appellante, il quale chiede lo stralcio della procedura avendo le parti raggiunto un accordo transattivo che prevede, tra l'altro, di caricare le spese a chi le ha anticipate e di compensare le indennità ripetibili.
Atteso che la tassa di giudizio va adeguatamente ridotta, la causa in appello non terminando con un giudizio di merito (art. 21 LTG).
