The Second Civil Chamber of the Ticino Court of Appeal struck the appellant's appeal from the roll because the advance on costs, ordered on 2004-09-13 with a deadline of 2004-10-06 and a warning under Art. 312 CPC, was paid only on 2004-10-13. Where the appellate court sets a peremptory deadline for payment of the advance and warns that failure to comply will lead to the appeal being deemed abandoned, payment made after expiry of the deadline is untimely and justifies striking the appeal from the roll. The decisive factor is the expiry of the peremptory time limit; a subsequent payment does not cure the default (consid. 1). Court costs follow the outcome and may be charged to the appellant (consid. 2).

richiamata la diffida 13 settembre 2004 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 6 ottobre 2004 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di

fr. 525.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;

considerato come il versamento sia stato effettuato solo il 13 ottobre 2004 e come, ritenuta la perentorietà del termine stesso, debba ritenersi tardivo,

decreta 1. L'appello 6 settembre 2004 di APPE1 avverso la decisione 28 luglio 2004 del Pretore del Distretto di Lugano, sezione 1, è stralciato dai ruoli per versamento tardivo dell'anticipo.

  1. Le spese del presente giudizio con tassa di giustizia per complessivi fr. 50.-- sono poste a carico dell'appellante.
