The appellant challenged a 6 July 1998 decision of the Lugano District Pretura but then, through counsel, withdrew the appeal on 16 July 1998. The Second Civil Chamber of the Ticino Court of Appeal held that the proceedings had thereby become moot and ordered the appeal struck from the docket. The court also decided that no fees or costs would be levied.
Withdrawal of an appeal renders the appellate proceedings devoid of object; the appellate court may strike the case from the docket. In such a situation, and absent a contrary order, no court fees or costs are charged (consid. implicit).
